Terms of Service

1. Agreement

These Terms of Service govern your use of Stacked ("Stacked", "we", "our", or "us") at runstacked.com and related services. By creating an account or using the service, you agree to these terms.

2. Eligibility and Account Responsibility

• You must be at least 18 years old and legally able to enter contracts.
• You are responsible for your account credentials and all actions taken from your account.
• You must provide accurate signup information and keep it up to date.

3. Service Scope

Stacked provides infrastructure for inbox-based outreach campaigns. Features may include inbox connection, contact management, campaign setup, sending queues, and campaign analytics.

Some features may be in beta and can change or be discontinued.

4. Acceptable Use and Compliance

You agree not to use Stacked to:

• Send unlawful, fraudulent, misleading, or harmful communications.
• Send spam or messages without a lawful basis or required consent.
• Violate anti-spam, privacy, telecom, consumer protection, or data laws.
• Bypass sending limits, safeguards, security controls, or rate limits.
• Upload malicious code, probe systems, or attempt unauthorized access.

You are solely responsible for recipients, messaging content, campaign targeting, and legal compliance in your operating countries.

5. Inbox Integrations (Google, Microsoft)

If you connect third-party inbox providers, you authorize Stacked to access and process account data required to operate selected features.

Your use of those integrations is also subject to the provider's own terms and policies.

6. Google API Terms

Where Google APIs are used, Stacked's use of data received from Google APIs follows the Google API Services User Data Policy, including Limited Use requirements.

Google user data is only used to provide requested features and is not sold for advertising profiling.

7. Payments, Beta Commitments, and Refunds

• Certain flows may require a beta commitment fee (for example NGN 1,500).
• Payments are processed by third-party providers; Stacked does not store full card details.
• Unless stated otherwise in writing, fees paid for access or commitments are non-refundable.

8. Suspension and Termination

We may suspend, restrict, or terminate access if we reasonably believe you have violated these terms, created abuse risk, or exposed the platform to legal, security, or deliverability harm.

9. Intellectual Property

Stacked and related branding, software, and content are owned by us or our licensors. We grant you a limited, revocable, non-exclusive right to use the service according to these terms.

10. Service Availability and Warranties

The service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, delivery rates, inbox placement, or provider uptime.

11. Limitation of Liability

To the maximum extent allowed by law, Stacked will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption arising from your use of the service.

12. Indemnity

You agree to indemnify and hold harmless Stacked from claims, liabilities, damages, and expenses arising from your use of the service, campaign content, or breach of these terms.

13. Governing Law

These terms are governed by applicable laws of your operating jurisdiction and any mandatory consumer protections that apply to you.

14. Changes to Terms

We may update these terms from time to time. Updated terms are effective when posted on this page with a revised date.
